Is it possible to use power of attorney (POA) for purposes of selling or buying properties?

Yes it can be used if the POA is a first-degree relative to the buyer or seller or if there is pre-approval from the real estate registration section in Dubai land department.

How long is the document validity for power of attorney?

The validity is Two years for (Sell/Grant/Mortgage) and Four years for (Buy/Accept grant) or the validity mentioned on the POA whichever is less.

Is it possible to use power of attorney (POA) for purposes of selling or buying off-plan/pre-registration properties?

Yes it can be used if the POA is a first-degree relative to the buyer or seller or if there is pre-approval from the real estate registration section in Dubai land department.

What are the requirements to approve a power of attorney issued from abroad?

The power of attorney has to be attested by the UAE embassy in the country of origin, then attested by Ministry of Foreign Affairs (MOFA), then legally translated to Arabic.

How can the property value be delivered to the seller in case a POA was present on behalf of the seller?

A manager cheque has to be drafted to seller’s name. Also, a statement from the seller that he received the full selling price of the property can be used if it was attested by a local notary public or Ministry of Foreign Affairs.

Can the property value manager cheque be drafted to seller’s POA name?

No it cannot, even if the power of attorney states otherwise.

Can a foreign company own a property in Dubai?

Foreign companies can own properties in free-hold areas in Dubai if they issue a license from any Free-zone authority in Dubai.

How can I pay Dubai land department fees?

You can pay Dubai land department fees by debit/credit card, or in the form of a manager cheque.

Can I pay Dubai Land department actions fees in “Cash” through your property trustee office?

No. And all the land department actions fees should be paid on Manager cheque only.

How much is Dubai land department fee for transfer of warehouse ownership?

The fee is AED10 per square meter of the plot area, or AED10,000 whichever is more, plus the title-deed issuing fee.

Can Approved property registration issue the MOA/Contract-F?
